Accident Coverage – Should the target website become unavailable, Datamam will replace the scraping software with a solution for a similar website chosen by the client, at no additional cost.
Adaptive Output Structure – Data output formats may be adjusted at any stage of the project without incurring extra fees.
Backup Team Assistance – In the event of unforeseen challenges or reasonable changes to the original scope, Datamam will allocate additional developers to ensure timely completion.
24/7 Technical Support – Datamam’s support team is available around the clock for any software maintenance or support issues, ensuring continuous process functionality.
Adaptation and Adjustments – If the target website undergoes updates or changes post- deployment, Datamam will promptly modify the software to address the changes.

Risk Mitigation Framework (RMF)
This Risk Mitigation Framework (RMF) is hereby issued by Amadaam LLC, a legal entity duly registered and organized under the laws of its jurisdiction, (hereinafter referred to as “Datamam”), the proprietor of the registered trademark Datamam.
Purpose
1.1 Purpose of the RMF The purpose of Datamam’s Risk Mitigation Framework (RMF) is to provide clients with a comprehensive plan to mitigate risks associated with data acquisition services. This framework ensures the continuity of services and offers flexibility in response to challenges that may arise during the project lifecycle. The provisions outlined below are legally binding upon the commencement of any data acquisition service agreement and apply automatically unless expressly waived in writing by Datamam.
Key Provisions
2.1 Accident Coverage In the event that the platform from which data is being acquired becomes unavailable or ceases to exist, Datamam guarantees the replacement of the data extraction software with a solution targeting a similar alternative platform chosen by the client, at no additional cost. A “similar alternative platform” refers to a platform that utilizes comparable technologies, infrastructure, or presents similar levels of difficulty in terms of access or extraction, based on Datamam’s assessment. Datamam reserves the right to determine, in its sole discretion, whether a replacement platform qualifies as “similar” under this provision. The replacement shall be executed within a commercially reasonable timeframe, ensuring minimal disruption or delay in data acquisition services.
2.2 Adaptive Data Output Structure Throughout the data acquisition process, the client may request modifications to the structure or format of the data being collected. Such changes may include, but are not limited to, adjustments to the data fields, formats, or the data delivery schedule. Datamam will endeavor to accommodate such requests at any point during the project without imposing additional fees, provided the requested changes fall within the scope of the original agreement. Modifications requested by the client will be considered “within scope” if they relate to data formats or structures that are similar in complexity and technical requirements to those initially agreed upon. Datamam has the sole discretion to determine whether a requested modification is within scope or constitutes a material change to the project. Should the client request modifications that exceed the original scope of work, such requests will be subject to further negotiation and may require additional costs.
2.3 Supplemental Development Resources. In the event of unforeseen technical challenges, impediments, or reasonable amendments to the scope of work within the Agreement, Datamam will deploy additional resources as necessary to meet the agreed-upon project deadlines. Datamam will act in good faith to avoid project delays, including the allocation of additional development personnel at no extra cost to the client, provided that the adjustments or challenges fall within the original scope of work. Should changes or challenges arise that necessitate additional resources outside of the agreed-upon scope, Datamam reserves the right to review the situation and may require further compensation or amendments to the project agreement. Datamam commits to maintaining open and transparent communication with the client regarding the allocation of resources and any potential impacts on the project timeline.
2.4 Technical Assistance Datamam provides 24/7 technical support as part of its commitment to ensuring the stability and continuity of its data acquisition services. Should any technical issues arise—whether related to system maintenance, platform changes, or other unforeseen events—Datamam’s support team will be available to provide immediate assistance. This round-the-clock support ensures minimal disruption and addresses any issues that may impact the performance of the data acquisition process. Datamam reserves the right to determine the appropriate method and timeframe for addressing and resolving technical issues, ensuring that any interruptions are handled efficiently and professionally. While 24/7 technical support is provided as a standard service, any excessive or unreasonable demands for support beyond what is customary may require additional costs, subject to prior agreement between the parties.
2.5 Platform Adaptation and Adjustment To ensure the data acquisition process remains operational and compatible with the evolving landscape of the target platform, Datamam provides Platform Adaptation and Adjustment services. This encompasses both Rapid Website Adjustments and Expedited Platform Adaptations to ensure that Datamam’s software can continue to function even as platforms undergo changes.
- Platform Updates: If the target platform undergoes updates, structural changes, or technological modifications after the final deployment of Datamam’s software, Datamam will promptly adjust the software to ensure continued compatibility and functionality. Adjustments will be made within a commercially reasonable timeframe, depending on the nature of the platform changes.
- Rapid Adjustment Process: For minor changes or updates in the platform that require immediate adjustments to ensure that data acquisition can proceed without disruption, Datamam will promptly implement these changes without additional cost to the client, provided they fall within the original scope of work.
- Expedited Adaptation Process: In cases of significant platform changes—such as major updates in structure, security protocols, or data accessibility—Datamam will implement a comprehensive software adaptation to address these changes. Datamam reserves the right to prioritize modifications based on the criticality of the platform’s update and the potential impact on the data acquisition process.
Datamam shall determine, in its sole discretion, whether a platform change requires minor adjustments or a significant adaptation. Should the adaptation fall outside the original scope of work, Datamam will notify the client, and additional discussions regarding costs and project timelines may be required.
Client
3.1 Client Responsibility While the client’s responsibilities are not a formal part of the This Risk Mitigation Framework (RMF), they serve as critical conditions for it to remain valid. The RMF provides protections and benefits to the client, but if the client fails to meet the following responsibilities, Datamam reserves the right to suspend or invalidate the application of the RMF. These responsibilities include:
- Timely Communication: The client must promptly notify Datamam of any changes to the target platform, project requirements, or data needs. Failure to do so may result in delays or the invalidation of RMF coverage.
Provision of Accurate Information: The client is responsible for providing accurate and up-to- date information regarding their data acquisition needs. Inaccurate or outdated information may prevent Datamam from delivering services effectively, potentially invalidating RMF coverage.
Compliance with Terms: The client agrees to comply with payment terms, deadlines, and other obligations set out in the data acquisition service agreement. Any breaches of these obligations may lead to delays or the suspension of RMF benefits.
Active Engagement: The client is expected to actively participate in decision-making processes, especially when significant changes or challenges arise during the project. A lack of engagement may hinder Datamam’s ability to implement the RMF effectively.
General Provisions
4.1 Unilateral Offer This Risk Mitigation Framework (RMF) constitutes a unilateral offer by Datamam to the Client and shall become legally binding upon the execution of any data acquisition service agreement. Although mutual agreement is required for the underlying data acquisition project, the RMF is intended solely as a unilateral benefit conferred upon the Client. The provisions of this RMF shall apply automatically unless expressly waived in writing by Datamam, and no further consent or action by the Client is necessary for its enforcement.
4.2 Standard Service Provision The RMF is an inherent and standard provision of all data acquisition services provided by Datamam. By engaging Datamam’s services, the client acknowledges and agrees to the terms of the RMF, which provides legal protections and obligations that are enforceable under the law.
4.3 Right to Modify Datamam reserves the right to modify or update this RMF at its sole discretion. Any modifications to the RMF shall be communicated to the client in writing. Changes will take effect upon notification, and the client’s continued use of Datamam’s services following any such modifications will constitute acceptance of the revised RMF.
Signatory
While the RMF is a unilateral framework designed for the benefit of the Client, the Client’s adherence to the responsibilities and obligations outlined herein is essential for the RMF to remain in effect. This RMF ensures service continuity, flexibility, and support throughout the data acquisition process, while maintaining a legally enforceable structure for Datamam’s commitments.
